The following terms apply to our paid 30-Day AI Build consulting engagement:
For projects outside the standard 30-Day AI Build package, terms including scope, timeline, payment schedule, and deliverables will be agreed upon in writing prior to commencement. These Terms apply to custom engagements except where superseded by a separate written agreement.
Our website, tools, and services are provided "as is" without warranty of any kind, express or implied. We do not warrant that our tools will be error-free, uninterrupted, or that the results obtained from their use will be accurate or reliable. Your use of our tools and services is at your sole risk.
To the fullest extent permitted by law, DemerseTech and Stuart DeMerse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our website, tools, or services — including but not limited to loss of profits, data, or business opportunities — even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or our services shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless DemerseTech and Stuart DeMerse from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of our tools or services, your violation of these Terms, or your violation of any third-party rights.
Our tools and services rely on third-party platforms including Anthropic, Stripe, GitHub, and Cloudflare. We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of these services is subject to their respective terms and policies.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts of Ellis County, Texas.
We reserve the right to update these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Continued use of our website or services after any changes constitutes your acceptance of the updated Terms.
